TERMS AND CONDITIONS
Please read and understand carefully
Commissioning the artist means that the client accepts the Terms and Conditions and that this shall serve as a primary contract.Failure to adhere to TOS such as scams or deception (removal of watermark, selling personal commissions commercially, reselling resin crafts, copying handmade designs, and not being honest about using the commissioned work for NFT, or use of work in order to feed to AI Applications) is considered as a breach of contract and is punishable by law.

CHAPTER I
GENERAL GUIDELINES

✧ The artist will NOT be accepting commissions which will be used for AI or NFT or Crypto-related activities. The artist reserves her rights to file any charges against a client who will attempt to or use the commission for the above mentioned activities as per violation of TOS.✧ Please understand that the artist may refuse to work on pieces with certain themes that they feel like they may not be able to properly represent, as they do not wish to misinterpret or misrepresent the people, culture, or beliefs behind it.✧ Commissioned pieces, including physical sculpted pieces, are for the client's personal use only (Ex : their own items or as gifts to close friends or relatives).✧ Should a client wish to use the commissioned illustration for commercial purposes, not including nft's, there will be additional charges. Please see USAGE FEES.✧ Physical sculpted pieces are NOT ALLOWED TO BE RE-SOLD OR REBRANDED BY THIRD PARTIES, INCLUDING THE CLIENT.✧ Physical Sculpt designs incur a half-fee payment for the design alone if the client is given a draft but they no longer wish to have the item made. Fee is 50% of the full rate of the product that would be ordered.✧ The artist will not illustrate public or popular figures and celebrities for commercial use unless the commissioner is the figure themselves. (Example : x celebrity/public figure commissions the artist to create a stylized print of themselves which they will use commercially or personally.)✧ The artist will only illustrate public or popular figures and celebrities, for personal use. (Example : Client wants image of daughter and x artist together, as their personal gift for their daughter)✧ The commissioned piece must not be claimed by the client as their own. Artist must be credited at all times, unless client has purchased NDA + full rights.✧ Alterations, especially the removal of signature is not allowed. Watermark removal will be considered as COMMERCIAL USE, and thus must follow commercial usage fees. This applies to illustration commissions. Resin Art commissions, however, are NOT allowed, either via reselling or to be resold under a different name or brand.✧ The artist reserves the right to decline the commission if it is too difficult or if the commission does not follow the given terms and conditions.✧ Visual references and mood boards are highly encouraged.✧ The artist may upload the commissioned piece to their social media sites, however, the client may opt to not be mentioned, should he/she/they prefer their privacy.✧ The client is free to upload their commissioned piece to any and all of their social media sites, with proper credit to the artist.

CHAPTER II
PROCESS AND PRODUCT

✧ General waiting time / turn-around time is 3 days to two (2) weeks for digital illustration, and two (2) weeks to six (6) months for resin crafts and physical paintings. Should there be a delay or hindrance due to schoolwork, health factors, and the like, the client will be updated as soon as possible.✧ Updates will be given two to three times per day and a continuous communication will be ensured.✧ For complicated and dynamic poses, the artist uses 3D models from EasyPoser to help with the overall base, unless the client has a specific pose in mind.✧ The client has unlimited revisions for the initial rough sketch, however, there will be a $10 charge for every revision once the final sketch has been made and approved.✧ A scanned, full resolution wallpaper-type file or a high resolution png file will be sent through e-mail. There will be no physical product for digital illustrations.✧ Two (2) images shall be sent to the client, one of which is the clear, high resolution original file with the artist's signature, and the other as a watermarked, low resolution version which both the artist and client may use when posting, to avoid art theft or the art being fed to AI.✧ Only resin art and physical paintings will have PHYSICAL PRODUCTS

CHAPTER III
PAYMENTS

✧ The artist will only start once payment has been confirmed.✧ Payment is upfront and 100% for commissions worth $300 and below. Commissions worth $300 and above can be made in 50/50.✧ A 50% down payment will be paid for commissions above $300. After a rough sketch has been approved, the client should then pay the remaining 50% for the artist to continue working on the project.✧ Art Retainer and Webtoon Bookings will have properly written contracts in order to ensure the protection and peace of mind of both the artist and client.✧ Currency is generally in USD, with payment method being Paypal. Local clients may also use Gcash, Maya, or Bank Transfer.✧ Clients who opt for Paypal as payment method will be billed via Paypal Invoice, so as to serve as official receipt.✧ Clients who opt for local payment methods will be given a separate digital invoice and receipt that can serve as official records.✧ The client is encouraged to wait for their slot before sending their payment.✧ If the client chooses to cancel once the artist has already started the piece, there will be no refunds.✧ If a situation arises in which the artist may not be able to accomplish the commissioned piece, the client will receive a full refund.
